Terms and Conditions of the Online Store BoyorGirl.org

§1. General Provisions

1.1. These Terms and Conditions define the rules for using the online store available at www.BoyorGirl.org.
1.2. The Seller is the entity operating under the name BoyorGirl.org, hereinafter referred to as the “Seller.”
1.3. The Seller can be contacted via email at: contact@BoyorGirl.org.
1.4. The Terms and Conditions are continuously available on the Store’s website in a form that allows the Buyer to download, save, and reproduce them.


§2. Definitions

2.1. Consumer – a natural person making a purchase not directly related to their business or professional activity.
2.2. Buyer / Client – any entity making a purchase in the Store.
2.3. Digital Content – animations in digital file formats (e.g. MP4, MOV) sold by the Seller.
2.4. Physical Products – tangible goods made to order using print-on-demand technology by a subcontractor (e.g. Printful).
2.5. Agreement / Contract – a distance sales contract concluded between the Seller and the Buyer.


§3. Scope of the Store’s Activity

3.1. The Store offers:
a) digital content in the form of animations,
b) physical products with personalized prints made to order.
3.2. Digital content is delivered exclusively in electronic form.
3.3. Physical products are manufactured and shipped by a subcontractor (Printful), while the sales contract is concluded directly between the Buyer and the Seller.


§4. Orders

4.1. Orders can be placed 24/7 via the Store’s website.
4.2. The Buyer selects a product, completes the order form (e.g. personalization details), and makes payment.
4.3. The sales contract is concluded at the moment the Buyer receives the order confirmation.


§5. Payments

5.1. The Seller provides the following payment methods:
a) electronic payments via Stripe Payments Europe, Ltd.,
b) other payment methods, if explicitly made available in the Store (e.g. bank transfer).

5.2. Stripe payments enable transactions using, among others:

  • payment cards: Visa, Mastercard, American Express,

  • mobile payments: Apple Pay and Google Pay,

  • local payment methods: BLIK, Klarna, Sofort, iDEAL, Przelewy24 (availability depends on country and currency).

5.3. All Stripe transactions are secured with SSL encryption and comply with the PCI DSS standard.
5.4. The Buyer making an electronic payment is required to complete it immediately after placing the order. Lack of payment within 2 business days may result in order cancellation.
5.5. The availability of payment methods may depend on the country, currency, and Stripe system configuration.

§6. Delivery

Digital Content:
Delivered electronically. The animation generation process usually takes several seconds to a few dozen seconds.
In exceptional situations (high server load, network issues), it may take several minutes.
Delivery cost for digital content: 0 PLN (free of charge).

Physical Products:
Products are made to order and shipped directly by the subcontractor.
Fulfillment time: 3–14 business days depending on delivery location.
Shipping costs are displayed during checkout.
The Buyer is responsible for providing accurate shipping information.


§7. Technical Requirements

7.1. To play animations, the Buyer needs a device supporting MP4 or MOV files, internet access, and a valid email address.
7.2. The Buyer is responsible for ensuring the proper technical environment.


§8. Right of Withdrawal

8.1. Digital Content:
Before making a purchase, the Buyer expressly consents to the immediate performance of the contract and acknowledges that upon delivery of the file, the right of withdrawal is lost.
Complaints are only possible if the file is damaged or does not match the description.

8.2. Physical Products:
Due to the personalized nature of the products (print-on-demand), they are not eligible for return due to a change of mind.
Complaints are accepted only in the case of defects, damage, or non-conformity with the description.


§9. Complaints

9.1. Complaints should be sent to: contact@BoyOrGirl.org.
9.2. For physical products, photos documenting the defect must be attached.
9.3. Complaints are processed within 14 business days of receipt.


§10. License for Using Animations

10.1. The Buyer receives a non-exclusive, non-transferable license to use the purchased animation for personal purposes.
10.2. The Buyer may share the animation on social media or send it privately (via email, messengers) if consistent with its intended use (e.g. pregnancy announcement, gender reveal).
10.3. It is strictly prohibited to:
a) resell the animation,
b) use the animation commercially without the Seller’s consent,
c) use the animation in materials containing offensive, vulgar, discriminatory, pornographic, or illegal content.
10.4. Copyrights to the animations remain the property of the Seller.
10.5. To obtain permission for commercial use of an animation, contact: contact@BoyOrGirl.org.


§10a. Physical Products – Terms of Use

10a.1. Physical products are intended solely for the Buyer’s personal use.
10a.2. Commercial use, mass production, or resale without the Seller’s consent is prohibited.


§11. Limitation of Liability

11.1. The Seller shall not be liable for:
a) inability to play the animation due to failure to meet technical requirements,
b) consequences of using the animation in violation of the law, license, or these Terms,
c) indirect damages (e.g. loss of profit),
d) delays caused by subcontractors (Printful) or courier services,
e) delays in delivering digital content due to causes beyond the Seller’s control (e.g. outages, overloads, force majeure).

11.2. The Seller remains liable to Consumers for product conformity with the contract in accordance with applicable law.


§12. Personal Data and Privacy Policy

12.1. The Seller is the controller of Buyers’ personal data.
12.2. Data is processed for the purpose of fulfilling orders and contacting the Buyer.
12.3. The Seller does not sell, share, or disclose personal data to third parties except when necessary to fulfill an order (e.g. sharing data with the subcontractor Printful).
12.4. For users from the European Union, data is processed in accordance with Regulation (EU) 2016/679 (GDPR).
12.5. Detailed data processing rules are described in the Privacy Policy available on the Store’s website.


§13. Intellectual Property Rights

13.1. All animations, graphics, and designs available in the Store are protected by copyright law.
13.2. The use of materials in a manner inconsistent with the granted license is prohibited.
13.3. Printful acts as a subcontractor; all rights and obligations under the contract exist solely between the Buyer and the Seller.


§14. Final Provisions

14.1. These Terms and Conditions take effect on the date of publication on the Store’s website.
14.2. The Seller reserves the right to make changes to the Terms, which take effect upon publication, provided that they do not infringe upon the acquired rights of Consumers.
14.3. Matters not regulated by these Terms shall be governed by the laws applicable to the Seller’s registered office and relevant international regulations.
